More details are unfolding around Tony Romo‘s arrest last week.
The 46-year-old retired NFL quarterback was arrested on Thursday (July 23) on suspicion of operating while intoxicated in Milwaukee, Wis.
Now, it’s being revealed that Tony allegedly had an open bottle of alcohol in his vehicle when he was arrested, according to Milwaukee County Sheriff’s Office citations obtained by People.
An officer discovered the bottle while they took inventory of his car before it was towed following the arrest. Per the citation, Tony is being fined $267 for possession of “open intoxicants in MV-driver.”
The former football player has also reportedly been cited for unsafe passing as officers say he drove “in the marked right distress lane to pass vehicles in lane 1 and 2 during rush hour traffic,” and he “cut across the marked gore.” This earns a citation of $235.
Tony is also being hit with a third citation, alleging he was “operating while under the influence,” which is an additional $1,066.
Bodycam footage, via NBC DFW, from his arrest also shows the officer walking up to his driver’s side door after pulling him over. She then asks where he was coming from, to which he replies he was going to visit his grandparents.
They talked about how it was hard to hear, and the officer asked him once again where he was coming from, and he said, “The golf course, and I’m going to meet grandma and grandpa.”
When asked how many drinks he has had, Tony said zero, and explained he was playing at an amateur golf tournament.
When asked to take a field sobriety test, the athlete said, “I’m going to call my lawyer… if that’s okay.”
He was then told to step out of the vehicle repeatedly, and he responded, “I’m not allowed to call my lawyer?”
Tony eventually stepped out, and he was handcuffed and placed into the police vehicle. He was then taken to a nearby police station, where the officer said she thought he was impaired due to having “red, glassy eyes,” and “the odor of an intoxicating alcoholic beverage from your breath.”
The officer noted that deputies discovered “a few shooters” in his bag, which he asked, “Any of them drank?”
After he was eventually led through various field sobriety tests, the officer asked if he would do a breathalyzer test.
“Oh no. We’re not doing that,” Tony said. “I’ve heard from multiple lawyers, ‘Don’t ever do that.’ So, we’re not going to do that.”
“Did I pass this test?” he then asked.
He was then told he was under arrest and placed back into the squad car. Tony was later released and is expected to appear in court on Monday, September 21st.
